Swibeco Perks & Discounts Platform User Terms
Your organization (the Client) has subscribed to the Swibeco Perks & Discounts Platform (the Service
or Platform).
The Perks & Discounts Platform enables you (User) to access and redeem exclusive Discounts, offers, and Prepaid Benefits for a selection of goods and services within designated Benefit Categories.
These Prepaid Benefits are offered to you by the Client and can be one or multiple of the following Benefit Categories:

If you are unsure which Benefit Categories are available to you, we encourage you to consult with the designated contact person in your organization or consult the Swibeco app, which provides up- to-date information.
This document (the Perks & Discounts Platform User Terms or these Terms) explains how the Platform works and outlines the terms and conditions that apply to:
- the use of the Service; and
- the purchase, delivery and sale of Discounts on the Platform.
Our Privacy Policy also applies. Together with these Terms and all referenced documents, they form the Contract between you and Swibeco for the Service.
When the Client subscribes to the Service, they accept these Terms on your behalf. By using or receiving the Service, you confirm your continued agreement to these Terms.
If there is a conflict between these Terms and other contractual documents:
- These Terms take precedence for matters specific to the Perks & Discounts Platform.
- For data protection matters, the Swibeco Privacy Policy takes precedence.
Capitalized terms used in these Terms have consistent meanings throughout this document. While we have aimed to make these Terms as clear and user-friendly as possible, some “legalese” have been included for compliance.
Please note that:
- Client refers to the organization that has subscribed to the Swibeco Perks & Discounts Platform. This is typically your employer but may also include other eligible organizations managing benefits on behalf of the User.
- Employer refers to the specific Client that provides you access to the Platform and may allocate Prepaid Benefits for your use.
- Unless otherwise specified, the terms “Client” and “Employer” may be used interchangeably in these Terms.
To ensure the Platform continues to meet our users’ needs, we may amend these Terms from time to time to reflect updates to our services, legal requirements, or business practices. All changes will be published on our website and will take effect upon publication. For material updates that significantly affect the Service, we will make reasonable efforts to notify you via email and/or in-app notifications.
We encourage you to review these Terms regularly. Continued use of the Service after updated Terms have been published means you accept the revised Terms.
2.2. How Access is Granted
Your access to the Platform is provided and managed by your Employer. The availability of certain features or benefits may depend on your Employer’s subscription to Swibeco.
You will receive an invitation from your employer to join the Platform. Once invited, you must create login credentials to securely access your account.
2.2. Maintaining Your Access
As long as your employer maintains your access, you may:
- Browse and enjoy Discounts on the Platform,
- Redeem Prepaid Benefits, if provided by your employer.
Your access is linked to your employment status or contractual relationship with the Client. If this relationship ends, your access may also be revoked. If the Client revokes or deactivates your access, your account will be deactivated, and you will no longer be able to use the Platform.
Swibeco does not control or decide access permissions—this is entirely at the discretion of the Client.
2.3. Employer-Specific Access Limitations
Your employer determines the level of access and benefits available to you. If your employer has a special arrangement with Swibeco under which they pay no Licence Fees, you may have limited access to certain offers, Discounts, or features.
If you have any questions about your eligibility, access, or available benefits, please contact your employer directly.
3.1. Overview of Available Offers
Swibeco provides you with access to attractive discounts, special conditions, and prepaid spending opportunities through the Swibeco Perks & Discounts Platform (Platform). The Platform features two types of offers:
- Swibeco Discounts are vouchers, products, goods, and services manufactured or distributed by Partners and offered on the Platform under special conditions. Swibeco acts as the contractual seller but does not manufacture, distribute, or provide the underlying product or service. The Partners remain responsible for their quality, performance, and availability. Any warranties, returns, or refund policies are governed by Swibeco’s terms and conditions available on the platform for each specific deal.
- Partner Discounts are products, goods, and services manufactured or distributed by Partners, which they offer directly to you at special conditions through the Platform. In these transactions, the Partner is the seller and is fully responsible for pricing, availability, warranties, order fulfillment, and customer service. Swibeco does not act as a contractual party or assume any liability for Partner Discounts.
Partners are third-party merchants, service providers, or distributors that collaborate with Swibeco to offer special conditions on the Platform.
The products, services, or vouchers available on the Platform (collectively, “Discounts”) may vary depending on your employer’s subscription and the Benefit Categories available to you.
3.3. Swibeco Discounts – Sold by Swibeco
Swibeco Discounts include:
- Products, services, or vouchers offered through Swibeco.
- Voucher Discounts – prepaid vouchers that can only be redeemed with the issuing Partner.
3.3. Partner Discounts – Sold by the Partner Partner Discounts may:
- Offer discounted prices or special conditions for Swibeco Users.
- Swibeco will redirect you to the Partner’s website to complete your purchase under their terms.
3.4. Buying Discounts with Prepaid Benefits
Prepaid Benefits are credits provided by your employer that allow you to purchase Swibeco Discounts within the Benefit Categories defined by your employer. They offer a seamless way to enjoy exclusive offers and discounts on the Platform.
For details on how to redeem them, please refer to the next section.
Prepaid Benefits allow you to purchase eligible Discounts within the Benefit Categories defined by your employer.
How to Use Your Prepaid Benefits
- When checking out, you can select Prepaid Benefits as your payment method for eligible Discounts.
- Your available balance and applicable Benefit Categories are displayed in your account.
- If you have any questions about your allocation or spending limits, please contact your employer.
Validity and Expiration
Prepaid Benefits remain available for use until they expire based on the following conditions:
- Standard Validity: Prepaid Benefits are valid for as long as your Employer maintains an active license for you.Clients under Special Arrangements: If your employer benefits from a special arrangement with Swibeco under which no License Fees (for example, in case of clients referred by a partner that has a special arrangement with us) are paid for your access, your Prepaid Benefits expire 24 months after allocation.
- Promotional Offers: If Prepaid Benefits are offered by Swibeco for a promotional offer, their validity period is determined by the terms of that promotion.
- After-Sales Service: If Swibeco credits you Prepaid Benefits as part of an after-sales service resolution, they are valid for 30 days.
- Cashback and Partners: Prepaid Benefits offered to you through cashback or through Partners, they expire 24 months after allocation.
You can check the expiration date of your Prepaid Benefits in your account.
Conditions of Use
- Prepaid Benefits can only be used to purchase eligible Discounts within the Benefit Categories assigned by your employer
- Prepaid Benefits cannot be exchanged for cash, transferred, or refunded.
- Once expired or if your access to the Platform is deactivated, you can no longer use any remaining Prepaid Benefits.
5.1. Availability of Discounts
Discounts are valid only while they are displayed and within the limits of available stock. Some Discounts may have limited quantities or specific eligibility conditions based on your employer’s agreement with Swibeco.
Swibeco cannot guarantee that Swibeco Discounts will always be available. For Partner Discounts, availability is governed by the Partner’s terms. Promotional offers may be time limited timewise or quantity-wise. If a promotional Deal is no longer available when you try to buy it, you won’t be able to complete the purchase.
5.2. Product Images and Descriptions
We do our best to provide accurate descriptions and images, but they’re for illustration only. The
actual product, service, or voucher may look a little different, and in case of differences, the real Deal takes priority.
Swibeco isn’t responsible for small errors, misprints, or pricing mistakes. Also, if you see something in a newsletter or an ad, remember that it’s for information only—it’s not a guaranteed offer.
5.3. Changes and Removal of Discounts
Swibeco may update, change, or remove Discounts at any time without notice. This can happen if:
- A Partner stops offering a Deal,
- A product or service is no longer available,
- There was an error in the price or description, or
- A promotional Deal has expired.
If a Deal is removed before you complete your purchase, we can’t guarantee the same price or conditions later.
5.4 What Happens if a Deal is Unavailable After Purchase?
- Swibeco Discounts: If you’ve already bought a Swibeco Deal but it turns out to be unavailable before it’s delivered or redeemed, we’ll cancel your order and refund you within 14 days. If you paid with Prepaid Benefits, we would refund you in Prepaid Benefit.
- Partner Discounts: If a Partner removes a Deal after you have placed an order but before fulfillment, the Partner is responsible for issuing any necessary refunds or alternative solutions under their terms. Swibeco is not involved in these transactions.
6.1. General Conditions for Ordering Discounts
- You can place an order for Swibeco Discounts and eligible Partner Discounts directly through the Platform.
- Your purchase becomes binding as soon as you confirm your order. You’ll receive a confirmation email or an in-app notification once the order is final.
- Your order is validated only once we have received full payment of the purchase price and any applicable costs (e.g., delivery charges).
- Swibeco reserves the right to refuse or cancel orders if they appear unusual or fraudulent, such as large quantities of the same Deal being purchased without a clear reason.
6.2. Purchase Prices and Costs
- All prices are displayed in Swiss Francs (CHF) and include VAT where applicable.
- Additional costs, such as delivery fees, are specified in the deal.
- Some special orders may require specific shipping conditions, which could result in extra assembly or handling fees.
- If the total value of your shopping cart is less than CHF 50.00, an additional handling fee of up to CHF 9.00 may apply.
Important Information Regarding Price Accuracy and Errors!
Swibeco strives to ensure all prices displayed on the Platform are accurate and continuously monitored. However, despite our best efforts, errors may occasionally occur due to factors beyond our control.
- For Swibeco Discounts, we take all reasonable steps to ensure pricing accuracy at the time of display.
- For Partner Discounts, Swibeco does not control pricing and cannot guarantee that the price displayed on the Platform will always match the final price on the Partner’s website. The Partner is solely responsible for the accuracy of their pricing.
Price discrepancies may arise due to:
- Technical issues, such as software bugs, system malfunctions, or incorrect price feeds from suppliers.
- Human errors, including incorrect manual data entry or outdated pricing information.
- Incorrect price feeds from Partners, where a Partner provides incorrect or incomplete pricing details.
- Display errors, where promotional discounts are incorrectly applied or misrepresented.
If a manifest pricing error occurs—such as an excessively high rebate, incorrect discount, or pricing mismatch—Swibeco reserves the right to cancel the order. Any payment already made will be refunded. If a manifest pricing error is discovered after a Deal has been fulfilled, Swibeco may seek recovery of the incorrect discount amount in good faith, including through an adjusted invoice or offsetting future purchases.
If you knowingly proceed with an order that contains a clear and obvious pricing error, we may consider the transaction invalid and recover any financial loss incurred, including by offsetting the refunded amount against future purchases.
We remain committed to transparency and accuracy in pricing and will take all reasonable measures to correct any identified errors as quickly as possible
Price Changes
- Swibeco and Partners may adjust prices at any time.
- The only binding price for your purchase is the one confirmed in your final order confirmation (unless there is a pricing error, see above).
6.3. Voucher Discounts
- Voucher Discounts allow you to purchase prepaid vouchers that must be redeemed directly with the issuing Partner.
- Voucher Discounts may be subject to time limits or other restrictions. Always check the specific offer details.
- Important: You cannot redeem a Voucher Deal with Swibeco, and no cash refunds or exchanges are possible.
6.4. Payment Methods and Conditions
- Payment can only be made using the methods specified at checkout. This includes payment via Prepaid Benefits (where applicable), credit card, or other payment providers as displayed at checkout.
- Swibeco retains ownership of Swibeco Discounts until full payment is received. We may suspend delivery or cancel the order if payment is not completed.
6.5. Payment Conditions for Partner Discounts
- If you purchase a Partner Deal, the Partner’s payment terms apply.
- Payment, refunds, and any billing issues related to Partner Discounts should be handled directly with the Partner.
7.1. Delivery of Voucher Discounts
- Voucher Discounts are delivered digitally and sent to you electronically via the Swibeco Platform and app.
- Redemption and delivery of the underlying product or service are governed by the Partner’s terms. Please check the relevant offer for applicable conditions, including expiration dates or any redemption restrictions.
7.2. Delivery of Swibeco Discounts
For Swibeco Discounts (where Swibeco is the seller), physical products and goods are shipped to your domicile in Switzerland or Liechtenstein. Please consult the Swibeco Discount information for possible delivery restrictions in Liechtenstein. In any case, we cannot ship or arrange shipping outside of these two countries.
Shipping & Logistics:
- Deliveries are handled by our manufacturers, distributors, or third-party shipping partners.
- Products are shipped to the delivery address provided at checkout. Please ensure that your details are correct, as Swibeco and its partners rely on this information to fulfill your order.
- Deliveries are made only to addresses that are easily accessible by lorry. If your address requires special delivery arrangements, any additional costs will be borne by you.
Failed Deliveries & Additional Costs:
- If a delivery attempt fails due to an incorrect address, absence of the recipient, or an inaccessible location, any extra costs for redelivery or return will be your responsibility.
- If the parcel is delivered to your building without requiring a signature and is lost or stolen, Swibeco and its shipping partners are not liable for the loss.
- If a product is returned due to unsuccessful delivery, Swibeco may charge additional handling fees for re-shipping.
Estimated Delivery Times:
- The estimated delivery time provided at checkout or in the order confirmation is indicative only and not binding.
- Delays may occur due to logistical issues, supply chain disruptions, or other unforeseen circumstances.
- Orders cannot be canceled due to delivery delays, unless explicitly permitted under the applicable terms.
7.3. Delivery of Partner Discounts
For Partner Discounts, Swibeco does not oversee shipping, handling, or estimated delivery times. Any concerns regarding delivery must be addressed directly to the Partner.
7.4. No In-Store Collection
Swibeco does not offer in-store collection. All physical orders are shipped to the designated delivery address.
8.1. Warranty for Swibeco Discounts (Where Swibeco is the Seller)
For Swibeco Discounts, warranty claims are handled directly by the Partner (the manufacturer or distributor of the product):
- Swibeco assigns all warranty rights to you, allowing you to contact the Partner directly for support.
- The Partner’s warranty terms apply to the product. Please check the product listing or warrantydocuments for details on coverage and duration.
- Inspection Upon Receipt: We strongly advise you to inspect the product as soon as you receive it. If you notice any defects or issues, you should report them to the Partner immediately to avoid losing your rights.
Voucher Discounts:
- For Voucher Discounts, any concerns about redemption, expiration, or conditions must be addresseddirectly to the issuing Partner.
- The Partner’s terms and conditions apply to the redemption and use of the voucher.
- Swibeco does not process refunds or provide support for voucher redemption issues.
Swibeco’s Role:
- Swibeco does not assume responsibility for product defects but is happy to assist in mediatingdisputes between you and the Partner where possible.
- Your exclusive remedies are those provided under the Partner’s warranty.
8.2. Warranty for Partner Discounts (Where the Partner is the Seller)
For Partner Discounts, the Partner’s warranty terms and conditions apply:
- Swibeco is not a party to the transaction and does not provide any warranties on behalf of the Partner.
- If you have a warranty claim or a product defect, you must contact the Partner directly.
- Swibeco does not assume responsibility for the quality, condition, or performance of PartnerDiscounts.
8.3. Swibeco’s General Warranty Disclaimer
Regardless of the type of Deal purchased:
- Swibeco does not provide warranties beyond those explicitly stated in these Terms.
- Swibeco excludes all liability for defects, malfunctions, or non-conformities, except where explicitlyrequired by law.
- Swibeco’s only responsibility is to operate the Platformand ensure the proper display of Discounts, tothe best of its ability.
The following restrictions apply to all Users:
- Manipulating Prices or Exploiting Errors:
- Any attempt to manipulate prices, take advantage of pricing errors, or knowingly purchase Discounts withincorrect pricing is strictly prohibited.
- Sharing Discount Codes or Exclusive Offers Externally:
- Discounts, discount codes, and special conditions available on the Platform are for personal use only and may not be shared, resold, or distributed outside of authorized Users.
- Fraudulent Activities:
- Users may not engage in fraudulent behavior, including but not limited to:
- Creating multiple accounts to benefit from promotional offers.
- Misusing Prepaid Benefits in any unauthorized manner.
- Providing false information to obtain access to Discounts.
- Unauthorized Commercial Use:
- The Platform is intended for personal use only. Users may not purchase Discounts with the intent to resell,distribute, or use them for business or commercial purposes.
- Abuse of Refund or Cancellation Policies:
- Any attempt to misuse refund or cancellation policies to obtain undue financial advantages is strictly forbidden.
- Interfering with Platform Operations:
- Users may not attempt to reverse-engineer, modify, hack, or disrupt the normal operation of the Platform in any way.
Swibeco reserves the right to suspend or terminate access in case of violations. If a violation results infinancial or reputational harm, Swibeco may seek compensation for damages.

Swibeco is committed to the highest standards of data protection and security. We are ISO 27001 certified, ensuringcompliance with strict international privacy and security requirements. Our
systems and processes are designed to protect your personal data and prevent unauthorized access.
Your privacy is important to us. Swibeco processes personal data in accordance with applicable data protectionlaws and the Swibeco Privacy Policy, which applies in full.
This section provides an overview of service-specific privacy considerations relevant to the Swibeco Perks & Discounts Platform. For a comprehensive explanation of how we process your data, including your rights and our obligations,please refer to our Privacy Policy.
What Data is Processed?
To provide you with access to the Platform and its Discounts, Swibeco processes the following data:
- User Identification & Access Data: Provided by your employer to create and manage your access.
- Transaction Data: Details of Discounts purchased or redeemed, including payment method (if applicable).
- Usage Data: Information related to your interactions with the Platform, such as browsing behavior andpreferences.
Who Has Access to Your Data?
Swibeco only shares your data with third parties when necessary to provide the Services. These third parties include:
- Merchants/Partners – If required to fulfill your order (e.g., for Swibeco Discounts and VoucherDiscounts).
- Logistics Companies – To ensure the correct and timely delivery of physical goods (where applicable).
- Payment Processors – To facilitate transactions, process payments, and manage refunds.
- Your employer can verify your eligibility for the Platform and manage Prepaid Benefits but cannot seedetails of your purchases or usage history.
11.1. Governing Law
These Terms and our Contract with you are governed by and construed in accordance with Swiss law, withoutregard to conflict of law principles.
11.2. Jurisdiction
Any dispute arising out of or in connection with this Contract shall be subject to the exclusive jurisdiction of thecourts of Lausanne, Switzerland.
Swibeco Card Terms & Conditions for Users
Your organization (which we also call the Client) has subscribed to Swibeco Card services for you (the
Service). Swibeco Card allows you to make payments using Prepaid Benefits (credits purchased by the Client foryou) at designated acceptance points, which correspond to specific themes or
categories. We call these themes Benefit Categories, which include the following:

Invitation and Information Submission: You will receive an invitation email from your organization (the Client) with instructions for accessing the Service. You must provide the requested information accurately.
Activation: Once your information has been validated, your access to the Service will be activated. A prepaid account (the Card Account) will be associated with your Swibeco Card, where prepaid benefits are allocated by your organization and from which payments are deducted when you use the Swibeco Card. You can start using the Service as soon as your Card Account has a positive balance.
Responsibility for Information: You are responsible for ensuring the information you provide is accurate and up to date. If your information changes, it is your responsibility to notify Swibeco and your organization promptly. Swibeco reserves the right to claim compensation for any damages, losses, costs, or expenses incurred, whether directly orindirectly, because of any provided information that is inaccurate, incomplete, or outdated, including in the event of a card returned due to an incorrect or outdatedaddress.
Assistance: If you encounter issues during the registration process or do not receive an invitation, please contact your organization’s representative or Swibeco at info@swibeco.ch.
Deactivation: If you no longer wish to use the Service, you must contact your organization to arrange for deactivation.We cannot process deactivation requests directly from users.
Balance Limits: For regulatory reasons, the maximum amount that can be available as a balance in your Card Account at any given time is CHF 5’000. Additionally, the total amount of prepaid benefits that can be allocated to your Card Account is capped at CHF 5,000 per calendar month and CHF 25,000 per calendar year.
Verification Requirements: Swibeco may request from you any information required for due diligence and transaction purposes. You undertake to promptly and diligently comply with any information request from Swibeco by providingaccurate, complete, and up-to-date information. If the information requested by Swibeco is not provided within 30 calendar days, the Service may be suspended or deactivated, and the Card Account closed. In such cases, any balance remaining in your Card Account will not be refunded. Swibeco is not responsible for any consequences to you in these circumstances.
Balance Management: Your organization manages and loads the prepaid benefits in your Card Account. You cannot personally top up your Swibeco Card or request overdraft or credit facilities. After each transaction, the balance in your Card Account is reduced by the corresponding amount. You can check your balance and transaction history atany time using the Swibeco app.
Transaction Review: If you identify an error or issue in your transaction history, you must report it within fourweeks. After this period, all transactions are considered final and accepted.
Validity of Benefits: Prepaid benefits remain valid as long as:
- The Client has an active subscription to the Service, and
- Your Service is activated.
If there has been no activity on your Swibeco Card for an extended period, Swibeco may contact you to confirmcontinued use.
Acceptance Points and Benefit Categories: Swibeco Card is accepted at a wide range of designated acceptance points, allowing you to enjoy the benefits provided by your organization. You can use Swibeco Card for purchases within the Benefit Categories specified by the Client.
If the balance in your Card Account is insufficient or if you attempt to make a purchase outside the specified BenefitCategories, the transaction will be declined.
Transactions may occasionally be declined at certain acceptance points or for certain Benefit Categories due toerrors in categorization by the payment network. The issuer accepts no responsibility for any inconvenience or lossresulting from such declines.
No Cash Withdrawals: For regulatory reasons, the Swibeco Card cannot be used to withdraw cash.
Personal Use Only: Swibeco Card is issued for your personal use and is registered exclusively to you as the designated user. The Service is non-transferable and may not be shared or used by anyone else.
The Swibeco Card is provided as a personalized card issued by our partner Yapeal. The Swibeco Card can be useddigitally with payment platforms such as Apple Pay, Google Pay, and Samsung Pay. A physical version of the Swibeco Card is also available, either provided by your organization, or to be purchased directly on the Swibeco app.
When using your Swibeco Card, you agree to the following duty of care provisions and confirm that you comply withthese provisions:
- The Swibeco Card and notes on associated security-relevant data (e.g., PIN) must be kept separately from each other and protected from unauthorized access.
- When ordering the Swibeco Card, a PIN must be defined for the card, which is known only to you as User. This PIN should not have any reference to you (e.g., telephone numbers, date of birth).
- You must keep the PIN secret. You must not disclose the PIN to any other person or make it accessible to others in anyform. The PIN must always be entered in a concealed manner.
- Likewise, you may not disclose the Swibeco Card or individual data relating to card, in particular the cardnumber and card validation code, to other persons.
- For certain internet transactions, merchants require two-stage authentication. In this case, the transactions must be confirmed during the payment process by means of an SMS code (one- time password). You are obliged to check the transactions to be confirmed for correctness. Unknown or incorrect transactions must not be confirmedand SMS codes for two-step authentication must not be passed on to third parties.
- Activation of a debit card for mobile payment may also require two-step authentication via SMS code (one-time password) or push provisioning. You are obliged to check the activation to be confirmed for correctness. Unknown activations or activations not made by you may not be confirmed and SMS codes for two-stepauthentication may not be passed on to third parties.
- You must act in good faith and take due care of the Swibeco Card and devices activated for Mobile Payment. Underno circumstances may you allow another person to use them. This includes protecting the devices securely from access by third parties (device-dependent: e.g., secure PIN, biometric login).
- If you notice or suspect that the terminal device or digital debit card or individual information has come into thecontrol of an unauthorized person (in particular loss or theft) or that unauthorized transactions have been madevia it, you are obligated to immediately change access features and methods and/or have the mobile payment functionblocked immediately and to inform Swibeco without delay.
Responsibility for Fees and costs: The costs of the Service, including any applicable setup fee, monthly administrative fees, and any additional costs, are typically borne by the Client.
Default Guarantee Costs: To comply with regulatory requirements, prepaid balances exceeding CHF 3’000 and up to CHF5’000 in your Card Account are protected by a default guarantee issued by a Swiss bank. Swibeco incurs costs for maintaining this guarantee and reserves the right to charge these costs to you and/or the Client if balances exceed CHF 3’000.
6.1. Term of the Service
You can use the Service as long as your organization maintains an active subscription for the Swibeco Card, and yourCard Account has a positive balance. We have described below the circumstances of terminating the Service andwhat happens after termination is processed.
6.2. Suspension/Termination by Swibeco
Suspension: Swibeco may temporarily suspend your access to the Service if:
- There is a suspected violation of these Swibeco Card Terms, the Contract, or applicable laws.
- Security concerns arise, such as unauthorized or fraudulent use of your Swibeco Card.
Suspension limits or blocks your ability to use your Swibeco Card until the issue is resolved (e.g., by proving noviolation of the Swibeco Card Terms, etc.).
Termination: Swibeco may permanently terminate the Service and deactivate your Swibeco Card if:
- Your organization has failed to pay the required fees or costs, even after receiving a payment reminder from us.
- You violate these Swibeco Card Terms or other provisions of the Contract.
- Termination is required for legal or regulatory reason.
Termination of this Contractresults in the closure of your Card Account and loss of access to any remaining balance.
Inactive Account: If no transactions are registered on your Swibeco Card for a period of 10 years, Swibeco may take steps to deactivate the Card Account and terminate the Service.
6.3. Termination by the Client
The Client may terminate the Service for an individual user (e.g., when the user leaves the organization) or for all users by cancelling or not renewing their subscription. When termination is communicated to Swibeco, the affected Card Account(s) will automatically be updated:
- No new prepaid benefits will be added to the Card Account(s) after termination is processed.
- You may continue to use any remaining balance in their Card Account for up to 24 months, subject to administrative fees of CHF 5 per month, which will be deducted directly from your Card Account.
- The Service will terminate automatically when the Card Account no longer has sufficient prepaid benefits to cover the monthly fee, reaches a zero balance, or after 24 months from your organization communicatingthe end of your subscription, whichever occurs earlier.
6.4. No Refunds
For regulartory reasons, any remaining balance in the Card Account after the Service is terminated will not be refunded.
To provide the Service, Swibeco collaborates with carefully selected third parties. These include:
- Payment network: Visa enables secure and widely accepted payments with the Swibeco Card.
- Card Issuer: Swibeco works with Yapeal AG (Yapeal), which manages the technical infrastructure for your Card Account and ensures smooth payment processing.
- Bank Guarantee: UBS Switzerland AG (UBS or the Bank) has issued a default guarantee for any amount exceeding CHF 3’000 and up to CHF 5’000 in the Card Accounts to comply with regulatory requirements.
- Other Service Providers: Swibeco may engage additional third-party providers to deliver specific features of the Service, such as transaction processing or regulatory compliance services.
Swibeco shares your data with these third parties only as necessary to ensure the proper functioning of the Service and to comply with applicable regulations. All third parties are bound by confidentiality obligations and data protection laws. Moreover, Swibeco is ISO 27001 certified, ensuring the highest standards in terms of data privacy and security.
Accuracy and Updates: You are responsible for providing accurate and up-to-date personal information when activating the Service. If your information changes, you must notify your organization and Swibeco promptly to ensure uninterrupted access to the Service.
Data Processing: Swibeco and its partners process your information strictly to deliver the Service. This includes managing your Card Account, processing transactions, and ensuring compliance with legal and regulatory requirements. In addition, Swibeco is entitled to share your data with the Bank providing the default guarantee referred to in Section 5. This sharing is strictly limited to the data necessary for the Bank to fulfill their regulatory obligations, maintain the guarantee or in order for you to benefit from the guarantee if applicable. The data concerned typically includes first name, last name, email, address, nationality, and card account balance.
Sanction Screening: Yapeal will perform sanction screenings prior to issuing the Swibeco Card in the name of the User. They might also do so from time to time for due diligence purposes. Should one or more Users be flagged by the sanction screening process, Yapeal will not be entitled to issue the
Swibeco Card. Swibeco has no responsibility in this process and cannot be held liable for any related inconvenience or loss.
Confidentiality: Swibeco treats your personal information with the utmost confidentiality. Your information will not be shared with third parties except as necessary to deliver the Service or as required by law.
Privacy Policy: For detailed information on how your information is collected, used, and protected, please refer to Swibeco Privacy Policy, which forms part of these Swibeco Card Terms. The Swibeco Privacy Policy governs all matters related to data collection, use, and sharing that are not explicitly addressed in these Swibeco Card Terms.
Personal Responsibility: Your Swibeco Card is equivalent to cash and must be handled with care. You are responsible for safeguarding your Swibeco Card and ensuring that it is not lost, stolen, or misused. In addition, you must maintain the security of any devices (e.g., smartphones or tablets) used to manage your Swibeco Card, including keeping apps updated and using secure passwords.
PIN and Access Codes: Keep your PIN and any access codes confidential at all times. Do not share them with others or store them in a way that could compromise their security. If unauthorized access occurs due to negligence in protecting your Swibeco Card, you will bear the consequences. You can change your PIN code at any time on the Swibeco app.
Reporting Loss or Theft: If your Swibeco Card is lost or stolen, you can block it directly in the Swibeco app. Alternatively, you must report it immediately to your organization (the Client) who will be able to block it. Prompt reporting ensures that Swibeco can take action to prevent unauthorized
transactions.
Liability for Unauthorized Use: Swibeco cannot be held responsible for unauthorized transactions if you fail to take reasonable measures to protect your Swibeco Card, PIN, or access codes. Note that individuals living in the same household as you are not considered third parties for the purposes of unauthorized use.
Responsibility for Accurate Information: You are responsible for providing accurate and up-to-date information when activating the Service and throughout its use. This responsibility is important not only to ensure uninterrupted access but also to comply with regulatory requirements. If inaccurate or incomplete information is provided, the Service may be suspended or terminated without notice, and you may bear any associated costs.
Compliance with Regulations: Swibeco Card operates within a regulated framework to ensure security and compliance. As part of this, certain information you provide may be verified to meet legal and regulatory standards. If verification requirements are not met, your Card Account may be subject to restrictions or closure. We decline all responsibility in this case.
Authorized Transactions: All transactions made using your Swibeco Card with the correct PIN or credentials are considered authorized by you and are final. If you believe there is an error or issue with a transaction, you must report it within four weeks; otherwise, it will be deemed accepted.
Disputes with Acceptance Points: Swibeco is not liable for any disputes arising from transactions at acceptance points. You must resolve such disputes directly with the merchant.
Indemnification: You agree to indemnify Swibeco for any costs, losses, or claims resulting from:
- The provision of inaccurate or incomplete information, including for regulatory or compliance purposes; and
- Misuse of the Service or violations of these Terms.
Exclusions of Liability: Swibeco is not responsible for:
- Any remaining balance in your Card Account after the Service is terminated. Note that you still have the right to use the remaining balance in accordance with Section 6.3.
- Unauthorized use of your Swibeco Card if you fail to protect it.
- Issues with acceptance points refusing or failing to process transactions.
- Delays, interruptions, or unavailability of the Service caused by events beyond its control, such as natural disasters, government actions, technical problems, or cyberattacks. Of course, we will do our best to resume the Service as soon as possible.
Notifications from Swibeco: Swibeco may communicate important updates regarding the Service through:
- Email,
- The Swibeco app, or
- Other electronic means.
Some communications or notifications may be provided exclusively through the Swibeco app. Please ensure you have access to the app and enable notifications. It is your responsibility to regularly check for such communications and ensure that emails or notifications from Swibeco are not blocked or sent to spam folders.

These Terms shall be governed, interpreted and construed by, under and pursuant to the substantive laws of Switzerland (excluding its conflict of laws provisions).
All disputes arising out of or in connection with these Terms, including disputes regarding their conclusion, validity, binding effect, amendment, breach, termination or rescission, shall be subject to the exclusive jurisdiction of the ordinary courts of Lausanne, Switzerland.
